Terms of service

The terms on which Voltcycle Pty Ltd supplies servicing, diagnostics, battery work and this website. Nothing here limits your rights under the Australian Consumer Law.

1. About these terms

These terms apply to the supply of goods and services by Voltcycle Pty Ltd (ABN 99 701 387 742, ACN 701 387 742) of Melbourne, Victoria, and to your use of the website at voltcycletec.site. In these terms, "we", "us" and "our" mean Voltcycle Pty Ltd, and "you" means the customer or website visitor.

By booking work with us, leaving goods with us or using this website, you accept these terms. If you do not accept them, please do not use the site or engage our services.

2. Our services

We provide servicing and repair for e-bikes, cargo bikes and e-scooters; lithium battery health diagnostics; battery pack repairs and rebuilds; motor, controller and wiring repairs; second-life pack rebuilds; and the collection and onward handling of end-of-life battery packs. The scope of any particular job is the scope set out in the quote or written report we give you for that job.

We may decline work. In particular, we may decline to repair a battery pack, a motor or a machine where we form the view that it cannot be returned to a safe condition, or where the work would require parts or information that are not available to us.

3. Quotes, bookings and diagnostics

Battery work begins with a diagnostic. We will tell you the cost of the diagnostic before we start it. The diagnostic fee is payable whether or not the results lead to further work, unless we agree otherwise in writing.

Quotes are based on the condition of the goods as assessed at the time and are valid for the period stated in the quote. If, once work begins, we find a fault that materially changes the cost or the scope, we will stop and contact you before continuing. Estimated completion times are estimates and are not guaranteed, as parts availability is often outside our control.

4. Prices and payment

Prices are in Australian dollars and include GST where GST applies. Payment is due on completion of the work and before goods are released, unless we have agreed different terms with you in writing. We may require a deposit towards parts on larger jobs. We retain ownership of any parts supplied until they have been paid for in full.

5. Your responsibilities

You agree that:

  • you own the goods you leave with us, or you are authorised by the owner to arrange the work;
  • you will tell us anything you know about the history of a battery pack, including any impact, submersion, overheating, swelling or previous opening or repair;
  • you will remove personal property from the machine before leaving it with us; and
  • you will collect the goods within the period we tell you once the work is complete.

Withholding known safety information about a battery pack puts our staff and premises at risk, and we may decline further work where it occurs.

6. Uncollected goods

If goods are not collected after the work is complete and payment has been requested, we will contact you using the details you gave us. Uncollected goods may be subject to reasonable storage charges, and we may dispose of them in accordance with the law applying to uncollected goods in Victoria after we have given you the notice that law requires.

7. Australian Consumer Law and consumer guarantees

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the problem rectified in a reasonable time and, if this is not done, to cancel the contract and obtain a refund for the unused portion.

For goods, you are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law.

8. Workmanship and battery limitations

We stand behind our workmanship and the parts we supply, in addition to your rights under the Australian Consumer Law. However, lithium cells are consumable items whose capacity declines with age, charge cycles, temperature and use. A diagnostic result describes the condition of a pack at the time of testing and is not a prediction of remaining life, and a repaired pack that shares its housing with older cells may not perform like a new one. We will tell you where that is the case before you decide to proceed.

9. Limitation of liability

To the extent permitted by law, and subject always to clause 7, our liability to you for any claim arising out of the supply of goods or services is limited, at our option, to resupplying the services or paying the cost of having them resupplied, or to replacing the goods, repairing the goods, or paying the cost of replacement or repair.

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of income or loss of use. We are not liable for pre-existing faults or wear that we were not engaged to inspect or repair, or for damage arising from information about the goods that you did not disclose to us.

10. Website content

The content of this website is provided for general information about our services. It is not technical advice about a particular machine or battery pack, and it should not be relied on as a substitute for a diagnostic. We take care to keep the site accurate but do not warrant that it is free of errors or that it will be available uninterrupted.

Do not attempt to open, repair or charge a damaged lithium battery pack on the strength of anything on this site. Contact us instead.

11. Intellectual property

All content on this website, including text, layout, graphics, drawings and the Voltcycle name and marks, is owned by or licensed to Voltcycle Pty Ltd and is protected by Australian and international copyright and trade mark law. You may view and print pages for your own personal or internal business use. You may not reproduce, republish, adapt or commercially exploit any part of the site without our prior written permission.

12. Privacy

We handle personal information in accordance with our privacy policy, which forms part of these terms and explains your rights under the Privacy Act 1988 (Cth).

13. Termination

You may cancel a booking at any time before work begins. Where work has already started, you remain liable for the work performed and the parts ordered up to that point. We may suspend or end our services where payment is overdue, where you breach these terms, or where continuing would be unsafe. Termination does not affect rights or obligations that have already accrued, including your rights under the Australian Consumer Law.

14. Changes to these terms

We may amend these terms from time to time. The version published on this page at the time you engage us is the version that applies to that engagement.

15. Governing law

These terms are governed by the laws of the State of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and of the courts able to hear appeals from them.
